1. Policy

Linn County Market respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement and, in appropriate circumstances, remove or disable access to infringing material and terminate the accounts of repeat infringers.

This policy applies to all content posted on www.linncountymarket.com (the “Platform”) by users, including listings, descriptions, photographs, video, and messages.

2. Filing a DMCA Notice (Takedown Request)

If you are a copyright owner or authorized agent and believe that material on the Platform infringes your copyright, send a written notice to our Designated Agent containing the following — required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or authorized agent;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it — preferably the listing URL and a description of the specific element;
  4. Your contact information: full name, mailing address, telephone number, and email;
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that omit any of these elements may be invalid under the DMCA and may not be acted upon.

3. Counter-Notice (Restoration Request)

If you believe your material was removed or disabled by mistake or misidentification, you may send a counter-notice to our Designated Agent containing — required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location at which it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, mailing address, and telephone number;
  5. A statement of consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the U.S. District Court for the Northern District of Iowa), and that you will accept service of process from the person who provided the original notice (or their agent).

Upon receipt of a compliant counter-notice, we will forward it to the original complainant. If they do not file a court action seeking a restraining order against the user within 10 business days, we may restore the material in 10 to 14 business days, in our discretion.

4. Repeat-Infringer Policy

In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances, accounts of users determined to be repeat infringers. We may terminate sooner where the infringement is egregious.

5. False Claims

Misrepresentations in a DMCA notice or counter-notice may result in liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f). Submit only notices and counter-notices that you genuinely believe to be accurate.
